On November 22, 2005, Deppo was arrested in Springfield, Illinois by the Drug Enforcement Administration for possession of cocaine with the intent to distribute. On the same day, Deppo appeared before a U.S. magistrate. He was given a trial date of January 25, 2006 He was placed on a $10,000 Own Recognizance bond and turned over to the U.S. Marshals Service for processing. After completing the U.S. Marshals Service's paperwork and signing the bond papers from the probation office, Deppo was released.

On January 25, 2006, Deppo did not appear for his trial. A bench warrant was then issued for his arrest for failing to appear. Deppo's whereabouts are unknown.
